Terms of service

1. Who you are contracting with

These terms are between you and Bustan e-Learning, HiLite Business Park, Olavanna, Kozhikode 673014, Kerala, India — info@bustanonline.com. By registering a student, or by using this website or our platform, you agree to these terms and to our privacy policy. If you do not agree, please do not use the service.

2. Registration and accounts

A student must be registered by a parent or legal guardian, who confirms they have authority to act for the child. Staff and applicants may register for themselves. Please give accurate information and keep your sign-in details, including any Google account you sign in with, secure. You are responsible for activity under your account and must tell us at once if you think someone else has used it.

3. Trial class and fees

• Registering and the trial class are free and commit you to nothing.
• We agree the fee with you in writing before classes begin, including what it covers and the billing period. Fees are billed in advance.
• We will give you at least 30 days' notice of any change to your fee, and you may cancel rather than accept it.
• A class your child misses is not refunded, but the recording is available. A class we cancel is rescheduled or credited.
• Online payments are processed by our payment provider; we never receive your full card or bank details.

4. Cancelling

Consumers in the EU, the EEA and the UK may cancel within 14 days of entering into this contract, without giving a reason, by emailing info@bustanonline.com. We will refund what you have paid within 14 days, less a proportionate amount for any classes you asked us to start within that period.

Anyone may stop classes at any time with one month's notice. We may end the arrangement on the same notice, or immediately under section 6.

5. Our service

We will teach the subjects and number of classes agreed, with a qualified teacher, and keep you informed of your child's progress. Live classes are recorded for catch-up, quality and safeguarding; our privacy policy explains how recordings are handled. We do not guarantee a particular academic result, and we do not promise that the platform will always be available or error-free.

6. Conduct and suspension

Please use the platform lawfully and respectfully. You must not give false information, disrupt classes, access another person's account, behave abusively, or record, copy or share classes, recordings or lesson material outside your own family. We may suspend or end an account where this happens; except in serious cases we will warn you first, and we will refund any fees paid for classes not yet taught.

7. Lesson material and your child's work

Our lessons, recordings and software are owned by or licensed to us, and may be used only for your own child's education on the platform. Your child's work remains theirs; we use it only to teach and assess them, and will not publish their work, voice, image or name without your written permission.

8. Liability

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law. Otherwise, our liability is limited to foreseeable loss and to the fees you paid us in the twelve months before the problem arose, and we are not liable for business losses. This does not affect your statutory rights as a consumer.

9. Complaints

Email info@bustanonline.com. We will acknowledge your complaint within two working days and respond in full within fourteen days.

10. Changes to these terms

We will tell you at least 30 days before any change that materially affects you, and you may cancel rather than accept it. Other changes will be posted here with a new date.

11. Governing law

These terms are governed by the law of India, and disputes are heard by the courts of Kozhikode, Kerala. If you are a consumer, you keep the protection of the mandatory consumer law of the country you live in, and may bring a claim in its courts.
